Landlord Tenant law is, in my opinion, one of the most precarious areas of law to navigate. It is one of the rare times where statute, rather than contract, dictates that the looser may end up paying the winners attorney fees. It is a subject that, by law, must be strictly construed in favor of the tenant. It is an area of law that has had a great many interpretations of that law decided in court cases, which means you may read the statute and think you understand the law yet be very much off base.
Not all eviction services are alike. Some attorneys just dabble in it from time to time and the cost to the client is accordingly high. Some services may be very cheap but not owned by an attorney who has that ethical duty of care and due diligence. Some firms only take large property management companies that are well oiled machines and won’t touch the smaller rental property owner as they frequently require more hands on involvement, time and education.
